1. Acceptance of Terms

By accessing or using Data2Buy Services (“the Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance.

2. Description of Services

We provide a platform for purchasing mobile data bundles (and related services) for supported networks. Orders are fulfilled through third-party providers. We do not guarantee uninterrupted availability of the Service or of any specific bundle or network. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice where practicable.

3. Account & Registration

You must provide accurate and complete information when registering. You are responsible for keeping your login details confidential and for all activity under your account. You must notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these terms or for other legitimate reasons.

4. Payment & Delivery

Payment is required before we process your order. We use secure third-party payment processors. Data bundles are delivered electronically to the recipient number you provide. Delivery times may vary due to network congestion or provider issues. We aim to deliver promptly and will treat orders as delivered when our provider confirms submission to the network. We guarantee that your data will be delivered or your money will be refunded in accordance with our refund policy below.

5. Refunds & Failed Orders

Due to the nature of digital data bundles, once data has been successfully sent to the recipient’s number, sales are final. Refunds or credits may be offered at our discretion when:

  • An order fails due to a technical or provider-side error on our side and the amount was charged.
  • We have explicitly agreed to a refund in writing (e.g. for support cases).

For failed orders where you were charged, we may resend the order to the provider or refund the amount (including to your wallet where applicable). You must request support within a reasonable time. Refunds do not apply where the error was due to an incorrect recipient number or other user error.

6. Prohibited Use

You must not use the Service to:

  • Violate any applicable law or regulation.
  • Infringe the rights of others or distribute harmful, offensive, or illegal content.
  • Attempt to gain unauthorised access to our systems, other accounts, or third-party systems.
  • Use the Service for fraud, money laundering, or any illegal purpose.
  • Resell or redistribute the Service in a way that conflicts with our reseller/agent terms (if any).
  • Abuse support channels or overload our infrastructure.

We may suspend or terminate access and report activity to authorities where appropriate.

7. Intellectual Property

The Service, including its design, text, graphics, logos, and software, is owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without our prior written consent. You retain ownership of content you submit; you grant us a licence to use it as necessary to provide the Service.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available”. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, express or implied, to the fullest extent permitted by law. Your use of the Service is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by law, we (and our directors, employees, and agents) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use or inability to use the Service. Our total liability for any claim arising from these terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred Ghana Cedis (GH₵100), whichever is greater. Some jurisdictions do not allow certain limitations; where applicable, our liability will be limited to the maximum permitted by law.

10. Indemnity

You agree to indemnify and hold harmless Data2Buy Services, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (including limitation of liability, indemnity, and governing law) will survive termination.

12. Governing Law & Disputes

These terms are governed by the laws of Ghana. Any dispute arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ghana. We encourage you to contact us first to resolve any issue informally.

13. Changes to the Terms

We may revise these Terms of Service at any time. We will post the updated terms on this page and update the “Last updated” date. Your continued use of the Service after changes constitutes acceptance. For material changes, we may notify you by email or a prominent notice on the site. If you do not agree to the new terms, you must stop using the Service.
